I agree that the author wanted us to think that Werner threw the diamond into the ocean but why would Werner throw a diamond away? He didn't know the legend or at least there's nowhere in the story that states he knew.
Marie-Laure asked him to do that and he had discovered that kindness was about the only thing they had left in the world, so he did exactly the thing she asked. No questions asked.
