Heroine (dressed as boy) pickpockets Hero. He catches the heroine but instead of taking "boy" to prision he takes "her" with him. Hero drunkenly, forces himself heroine when he discovers she is not a boy. He wanted to stop once he realized she was a virgin but was too drunk to stop, but then immediately after he abondones heroine with some family member of his (that family member decides to help the girl become a lady) When hero returns he no longer finds a ill speaking girl but a lady and falls for her.
Maybe it’s The Copeland Bride by Justin Cole or Once More, Miranda by Jennifer Wilde, both have a pickpocket heroine. Not sure if all the details match though!
