Good question and one that comes up a lot in the indie community.
Yes, it's absolutely fine to have the same image, because most of us get our images from stock photo sites, and as long as you buy the image, anyone can use it. Bully's image had already been used on a couple of covers before I used it, and I didn't realize. I certainly don't own the sole rights ;)
Now if they're using the same colors, fonts, etc. that may be a type of infringement on my designer, so that's another story.
