Richard A. Posner, a Reagan-appointed federal judge on the Seventh Circuit and the most well-respected federal judge not on the United States Supreme Court, yesterday destroyed the arguments of the lawyers seeking to defend a ban on same-sex marriage.
I have not read the book Judge Posner wrote on Sex and Reason that is linked to here, which was published by Harvard in 1994.
I disagree entirely with Josh Blackman's analysis. It's far past time someone fought back on behalf of LGBT individuals. And it's nice to know that someone who was at least nominally conservative but is principally a leading, independent thinker, legal scholar, and judge is doing so. A refusal to tolerate intolerance is not intolerance.
